One challenge faced by aesthetics is the development of an account able to trace out the continuities and discontinuities between general experience and aesthetic experiences. Regarding this issue, in this paper, I present an enactive model of some raw cognitive dynamics that might drive the progressive emergence of aesthetic experiences from the stream of general experience. The framework is based on specific aspects of John Dewey’s pragmatist philosophy and embodied aesthetic theories, while also taking into account research in ecological psychology, (...) cognitive sciences, and dynamic systems theory. The model focuses on dynamically relevant nodes at the pre-reflective and the reflective side of experience that would work as nested rhythmic constraints at different cognitive timescales with the potential to shunt experiences toward the aesthetic in everyday situations. My proposal constitutes a way to explore aesthetic experiences from an enactive perspective that regards them as transformative events in which cognitive processes entrain and are entrained by changes taking place in the environment, the brain, and the body. This book examines the human ability to participate in moments of joint feeling. It presents an answer to the question concerning the nature of our faculty to share in what might be called episodes of collective affective intentionality. The proposal develops the claim that our capacity to participate in such episodes is grounded in an ability central to our human condition: our capacity to care with one another about certain things. The author provides a phenomenologically adequate account of collective affective (...) intentionality that takes seriously the idea that feelings are at the core of our emotional relation to the world. He details a form of group emotional orientation that relies on the fact that the participating individuals have come to share a number of concerns. Readers will learn that at the heart of a collective affective intentional episode, one does not merely find a set of shared concerns, but also a particular mode of caring. In the end, the argument presented in this monograph makes plausible the idea that the emotions through which humans participate in moments of affective intentional community express our nature. In addition, it shows that the debate on collective affective intentionality also permits us to better understand the relationship between two conflicting philosophical pictures of ourselves: the idea that we are essentially social beings and the claim that we are creatures for whom our personal existence is an issue. Thus, aiming at an elucidation of the nature of our ability to feel together, the book offers a detailed account of what it is to situationally express our human nature by caring about something in a properly joint manner. Current frameworks on ethical decision-making process have some limitations. This paper argues that the consideration of moral competencies, understood as moral virtues in the workplace, can enhance our understanding of why moral character contributes to ethical decision-making. After discussing the universal nature of four moral competencies (prudence, justice, fortitude and temperance), we analyse their influence on the various stages of the ethical decision-making process. We conclude by considering the managerial implications of our findings and proposing further research.

Integrated Information Theory (IIT) stands out as one of the most promising theories for dealing with the hard problem of consciousness. Founded on five axioms derived from phenomenology, IIT seeks for the physical substrate of consciousness that complies with such axioms according to the criterion of maximally integrated information (Φ). Eventually, IIT identifies phenomenal consciousness with maximal Φ or, what is the same thing, with the strongest cause-effect power in the system. Among the scholars critical of this theory, some point (...) to the so-called Intrinsicality Problem (IP), namely that consciousness cannot be an intrinsic property of the system because maximal Φ crucially depends on the possible existence of bigger values of Φ if the initial system is appropriately linked to or embedded in larger systems. Although proposals in the recent literature aim to solve the IP by going beyond reductionism and physicalism, none of them tackle the real issue, i.e., the insufficiency of IIT’s causal-metaphysical structure. This papers endeavors to provide a solution to the IP in IIT within a hylomorphist ontology that includes formal causation. Complementing IIT with formal causation provides the theory with a criterion of individuation that solves the IP and, by relaxing identification between maximal Φ and consciousness, it lends a more robust metaphysical structure. To wit, maximal Φ is a necessary but not sufficient condition for the existence of consciousness. (shrink)

Integrated Information Theory (IIT) stands out as one of the most promising approaches to scientifically understand the emergence of consciousness. Even if it borrows from the phenomenology of consciousness to derive its axiomatic formulation, IIT does not initially adhere to any particular ontological position. However, its founder leans towards Panpsychism. More recently, Owen has studied the pros and cons of different ontologies as a metaphysical basis for IIT, defending a hylomorphic stance where en-grounding, en-forming relations gain the upper hand in (...) the causal narrative. This paper aims at (1) complementing Owen’s work by invoking additional arguments against physicalist IIT, both reductive and non-reductive; and (2) improving Owen’s characterization of non-physicalist causality through a “nested” version of hylomorphism that avoids the combination problem of Panpsychism. I offer a phenomenological description of undocumented immigrant reason, provisionally understood as a sort of historical reason grounded on undocumented immigrant life. That is, the categories of undocumented immigrant reason are resources for undocumented immigrant existence and are inscribed in the historical memory of immigration (they are shared and communal), accessed by immigrants in stories, anecdotes, and interpersonal trauma. Abstracting from personal experience, testimony, popular culture, and elsewhere, I propose a fragmentary list of these categories of undocumented immigrant reason, a (...) list that includes journeying, crossing/nepantla, uncertainty/zozobra, nostalgia, and return. These categories, which structure undocumented immigrant reason, are reflected in beliefs and attitudes about migration, belonging, the contingency of life, the centrality of memory, and the meaning of death. Constitutive of immigrant rationality are beliefs and ways of being that lend meaning to immigrant life, including those beliefs and ways of being that place immigrants in closer proximity to fundamental human truths. The standard view in current philosophy of creativity says that being creative has two requirements: being novel and being valuable. The standard view on creativity has recently become an object of critical scrutiny. Hills and Bird have specifically proposed to remove the value requirement from the definition, as it is not clear that creative objects are necessarily valuable or creative people necessarily praiseworthy. In this paper, I argue against Hills and Bird, since eliminating the element of value from the explanation (...) of creativity hinders the understanding of the role that creative products play in actual epistemic practices, which are fundamentally normative. More specifically, I argue that the terms ‘creativity’ and ‘creative’ function as thick epistemic concepts when employed by competent epistemic agents in practice, that is, these concepts have both a descriptive and an evaluative content that cannot be disentangled from one another. Accordingly, I suggest that philosophers should prefer thick accounts over thin accounts of creativity. A thick account of creativity is one that endorses the standard view at its basis, but further develops it in two ways: by stressing the entanglement of the value and novelty requirements; by permitting to encompass a range of domain-specific characterizations of such entanglement for different epistemic situations. In order to take the first steps in the development of such a thick account of creativity, I look at the domain of scientific practices as a case in point, and try to spell out what the thickness of creative instances typically entails here. Namely, I identify the worthy novelty of creative models and methods with their potential to clarify a tradition, with fruitfulness, and with the fulfilment of exploratory aims. (shrink)

This paper explores and expands upon Jorge Gracia's reasons for the apparent lack of Hispanics in US philosophy. The point is to explain the underrepresentation of Hispanics in philosophy, with a focus on a specific subgroup of Hispanics, namely, "homegrown" US Hispanics. This group wasentirely missing from the "established" ranks in Gracia's census. I propose a phenomenological explanation for this lack, rooted in my experience as ahomegrown US Hispanic. This experience gives rise to a sense of identity described as "post-immigrant." (...) Those of us in the American philosophical establishment who share this identity, or who feel its pull, desire but hesitate to fully and authentically engage philosophy and the philosophical life, where thisrequires an uncompromising insertion of our cultural and historical identity into what we write and teach. RESUMEN El objetivo de este artículo de reflexión teórica es establecer un dialogo entre las ciencias sociales hoy en crisis y los aportes que encontramos en la cosmovisión me-soamericana para el diseño de una nueva matriz epistémica más ecológica y menos agresiva con la vida. En la primera parte se rastrea epistémicamente la genealogía de la cosificación de la naturaleza y de la vida que ha puesto en crisis el proyecto de la modernidad y las ciencias sociales, a partir de (...) la experiencia de la colonialidad, el ser como identidad y las matemáticas. En un segundo momento se cuestiona el eurocentrismo de las ciencias sociales y se defiende el diálogo con las otras epistemologías silenciadas por la razón occidental. De esta forma se exploran algunos aportes ontológicos de la epistemología mesoamericana para el diseño de nuevas relaciones sociales menos agresivas con la naturaleza y la vida. Finalmente se plantea favorecer los diálogos interpistémicos entre las distintas civilizaciones y culturas del mundo para abrir y repensar las ciencias sociales. ABSTRACT The objective of this article of theoretical reflection is to establish a dialogue between the social sciences, today in crisis, and the contributions found in the Me-soamerican worldview, to design a new epistemic matrix, more ecological, and less aggressive with life. In the first part, the genealogy of the reification of nature and life, that has put the project of modernity and social sciences in crisis, from the experience of coloniality, being as identity, and mathematics, is epistemically traced. In a second moment, the eurocentrism of the social sciences is questioned, and dialogue with other epistemologies, silenced by western reason, is defended. In this way, some ontological contributions of the Mesoamerican cosmovision are explored, to create new social relationships, less aggressive with nature and life. Finally, to favor the inter-epistemic dialogues between the different civilizations and cultures of the world is put forward, as a way to open and rethink social sciences. (shrink)

A new approach to landscape ecology involves the application of the eco-field hypothesis and the General Theory of Resources. In this study, we describe the putative eco-field of bark beetles as a spatial configuration with a specific meaning-carrier for every organism-resource interaction. Bark beetles are insects with key roles in matter and energy cycles in coniferous forests, which cause significant changes to forestry landscapes when outbreaks occur. Bark beetles are guided towards host trees by the recognition of semiotic signals using (...) a specific eco-field. These signals mainly comprise a group of scents, which are called the odourtope. Their interactions with other organisms occur by sharing relevant information from the eco-field networks in the forest ecosystem. The eco-field networks modulate the expansion of the realized semiotic niche of the bark beetle towards the potential semiotic niche. Moreover, the niche construction process can be initiated by interchanging signals among species living in the same place, where these signals allow the exploitation of the required resources. If different organisms are interdependent on signals in eco-field networks, then this process may result in the establishment of mutualistic relationships. This is an example of how evolutionary processes are initiated by the recognition of signals in a network of eco-fields. (shrink)

Health‐related data uses and data sharing have been in the spotlight for a while. Since the beginning of the big data era, massive data mining and its inherent possibilities have only increased the debate about what the limits are. Data governance is a relevant aspect addressed in ethics guidelines. In this context, the European project BRIDGE Health (BRidging Information and Data Generation for Evidence‐based Health policy and research) strove to achieve a comprehensive, integrated and sustainable EU health‐information system. One of (...) the aims of the project was to evaluate the requirements to construct a data‐linkage infrastructure for the secure management of health information. In a blueprint provided for this infrastructure, the topics ethics and the intimately related governance occupied a whole section, where the recent ethics guidelines by the Council for International Organizations of Medical Sciences (CIOMS) and the World Medical Association (WMA) were referenced. We explore what has changed in the latest versions of the ethics documents adopted by CIOMS and WMA regarding the management of health data and human tissues, the appropriateness of their application in new forms of research and infrastructures as the proposed in the BRIDGE Health project, and whether society should be so concerned about this topic, in the digital era of social exchange. In seiner Auseinandersetzung mit Eberhard behauptet Kant, Kritizismus sei die eigentliche Apologie von Leibniz. Diese Äußerung darf nicht einfach als sarkastisch abgetan werden. Kant kann dies insofern ernsthaft denken und behaupten, da für ihn die Transzendentalphilosophie die wesentliche philosophische Bedeutung des leibnizschen Gedankens aufhebt, liegt doch schon in Leibniz ein kritizistischer Kern, welcher wiedergewonnen werden kann. Man sieht hier nur einen Aspekt dieser historischen Transformation von Leibniz im kantischen Gedanken, und zwar: die explizite Behauptung Kants, das Konzept der prästabilierten Harmonie (...) werde in der Theorie der reflektierenden Urteilskraft und im Begriff der Zweckmäßigkeit kritisch aufgehoben. Dazu muss man jedoch vorher den Grundzug des kritischen Unterschieds zwischen Kant und der leibniz-wolffschen Philosophie durch eine Diskussion über die Bedeutung des Begriffs des Transzendentalen erläutern. BackgroundMonitoring recovery–stress balance in sport is becoming more relevant to prevent training maladaptation and reach the optimal performance for each athlete. The use of questionnaires that identify the athlete’s recovery–stress state have much acceptance in sports due to reliability and useful, furthermore for its low cost. Identifying possible differences between sport modalities and sex is important to determine specific needs and possible intervention ways to keep a recovery–stress balance. The aim was to analyze the differences in the recovery–stress state and (...) mood states by sex and sport type during the competitive phase in young Mexican athletes. As a secondary objective, the psychometric properties of the Mexican version of the Recovery–Stress Questionnaire for Athletes were analyzed.MethodsA cross-sectional study was carried on with 461 athletes, 17.95 years old, from six sports disciplines. The RESTQ-Sport and Profile of Mood States were applied in a single moment. Differences by sex and sports modality were analyzed. RESTQ-Sport’s confirmatory factor analysis was performed after the stress and recovery theoretical structure of two stress and two recovery dimensions, and last, the concurrent validation with the POMS was carried on.ResultsSignificant differences by sex were found in the General Recovery and Sport Stress dimensions of the RESTQ-Sport as well as Vigor factor of the POMS, being higher for men; furthermore, both the Sport Recovery dimension of RESTQ-Sport and Cholera and the Fatigue and Depression factors from POMS also had differences by sport type, showing a less recovery and high stress for individual sport athletes. Goodness-of-fit indexes of the model for the RESTQ-Sport were acceptable. Pearson’s correlation between questionnaires was moderate.ConclusionThe recovery–stress state shows differences in the function of sex and sport modality. More special attention is suggested for women and individual sport athletes. The higher punctuation for men compared with women in sport stress dimension did not negatively affect the recovery–stress balance for male athletes. Finally, the Mexican context adaptation of the RESTQ-Sport provides a psychometric instrument suitable to assess the recovery–stress balance in Mexican athletes. (shrink)

Studies investigating the COVID-19 pandemic from a psychological point of view have mostly focused on psychological distress. This study adopts the framework of existential positive psychology, a second wave of positive psychology that emphasizes the importance of effective coping with the negative aspects of living in order to achieve greater wellbeing. Trait emotional intelligence (trait EI) can be crucial in this context as it refers to emotion-related personality dispositions concerning the understanding and regulation of one’s emotions and those of others. The present study investigated the relationship between trait EI and both wellbeing and psychological distress (i.e., depression, anxiety, and stress), while exploring the mediating role of meaning-centered coping (proactive transformative strategies based on meaning in life) and maladaptive coping (i.e., behavioral disengagement and self-blame) during the first few months of the COVID-19 pandemic. A sample of 326 Lebanese adults completed measures of trait EI, wellbeing, psychological distress, coping, and meaning-centered coping. Results showed a strong positive correlation between trait EI and meaning-centered coping. Trait EI also correlated positively with wellbeing and negatively with psychological distress. Structural equation modeling showed that meaning-centered coping partially mediated the relationship between trait EI and wellbeing. Maladaptive coping fully mediated the relationship between trait EI and psychological distress. Findings indicate that trait EI is positively related to dealing with a stressful situation such as the pandemic in positive ways at both the cognitive level, by reformulating the situation to see something valuable in it, and behavioral level, by being proactive about it. Trait EI was positively linked to seeing the situation as an opportunity for personal growth, finding personal meaning in this situation, maintaining an attitude of hope and courage, and acting more responsibly with one’s self and others during the current crisis. In turn, this coping formula was related to lower psychological distress and improved mental health. These results are consistent with the existential positive psychology framework and can inform implementation programs and policies aiming at raising awareness and promoting healthy and successful coping during the pandemic. The present study aims to apply a program based on Hellison’s Teaching Personal and Social Responsibility Model (TPSR), traditionally used in Physical Education, to other educational subjects and examine the assessment of the teachers who carried it out during the 2018-2019 school year. The program was applied over eight months of one academic year and during at least 60% of the weekly class hours. Initially, 586 students participated, 429 being experimental subjects with 30 teachers, of whom 16 participated in the (...) interviews carried out, all of them being Secondary Education teachers. We used qualitative methodology through content analysis carried out with ATLAS.ti 7.1.3. The instruments used to collect information were semi-structured recorded group interviews. The conclusion is that the Personal and Social Responsibility Model can be applied to all subjects in the curriculum and is adaptable to any content and type of student body. As a basis for future research, we suggest the application of the model by all teachers involved in the same school year and the participation of students’ families. (shrink)

Deception scholars have argued that increasing the liar’s cognitive system artificially can produce deception cues. However, if too much load is imposed the truth tellers’ performance can also be impaired. To address this issue, we designed a veracity task that incorporated a secondary task to increase cognitive load gradually. Also, because deception has been associated with activity in the inferior frontal cortex (IFC), we examined the influence of transcranial direct current stimulation of the IFC on performance. During stimulation, participants truthfully (...) or deceptively indicated whether each of a number of statements shown on screen was true or not. Higher load decreased recall but not general compliance or response times (RTs). Truthful trials yielded higher compliance rates and faster RTs than deceptive trials except for the highest load level. Anodal right stimulation decreased compliance in truthful trials when participants were not overloaded. Truth telling was more vulnerable to cognitive load and tDCS than lying. (shrink)

This research aims to fill a major gap in the relevant literature on small businesses in developing countries, specifically concerning the development of models to better explain economic and environmental performance as a result of environmental compliance, thus moving toward an explanation of the sustainable behavior of these businesses. Data from 186 pottery craft businesses located in three Mexican states (Oaxaca, Puebla and Tlaxcala) reveal that environmental compliance significantly influences economic and environmental performance, with the mediating role of environmental innovation, (...) confirming the Porter hypothesis in the context of small businesses in an emerging economy. Environmental compliance is an important factor in improving the economic and environmental performance of small businesses in emerging economies. (shrink)

This paper proposes a reassessment of Hegel’s critical reading of Spinoza and of the charge of acosmism, for which this reading is known. We argue that this charge is actually the consequence of a more fundamental criticism, namely Spinoza’s presumable inability to conceive the unity of the finite and the infinite. According to Hegel, the infinite and the finite remain two poles apart in Spinoza’s metaphysics, which thus fails to be a true monism, insofar as it contains an irreducible duality. (...) Against this reading, we argue that Spinoza’s conception of the causal co-determination of finite modes entails the acknowledgment of their essentially infinite nature. The study of this particular instance of coincidentia oppositorum enables to counter some of Hegel’s criticisms as well as to illuminate a fairly unexplored aspect of Spinoza’s substance monism. Given the reality of legal orders collapsing or breaking, this paper argues that a good explanation is needed to understand this phenomenon. It adopts a Hartian account of positivism and considers law as part of a larger set of social facts and orders. The paper analyzes the relationship between evil moral commitments and the law. It concludes by showing that it might be more conducive to analyzing the loss of faith in a legal system as an explanation for its collapse (...) rather than thinking about problematic commitments to evil moral attitudes. This study examines the cultural roots of ethical conflicts in the global business environment. It begins with a brief look at worldviews on ethical behavior in general. Based on this, it is argued that an in-depth understanding of ethical conflicts has been hampered by an overreliance on Western models and viewpoints. Three common sources, or bases, of ethical conflicts are discussed as they relate to business practices, including conflicts over tastes and preferences, the relative importance of moral imperatives compared to (...) legal requirements, and people’s level of tolerance for different values among others. It is then argued that an understanding of ethical conflicts can be facilitated through different levels of understanding, including the meaning of universal values, the relationship between values and practices, and the existence of multiple levels of conflict within the same organizations or industries. These specific and interrelated ingredients in cross-cultural ethical conflicts form the basis for a broader discussion of the meaning of truth as it relates to such conflicts. The paper concludes with the need for more research that is cross-cultural and multidisciplinary in order to improve theory building and managerial practice. (shrink)

In recent years, after various scandals, the role of auditors has been called into question, even casting doubt on whether their reports reliably reflect the true financial situation of the auditee, especially when this situation is not good. Normative changes in the way auditors have to rate certain questions provide a good opportunity to study this problem. These changes have acquired great relevance among the factors involved in studying audit quality. Thus, the present study analyzed the effect of the normative (...) change that took place in Spain in December 2010, related to opinions modified for going-concern uncertainties. Until that date, the auditor’s uncertainty about the company’s going-concern status led to a qualified opinion. However, under the new regulation, it became an opinion that included an explanatory paragraph stating the reasons for concern, which was considered less serious. In all, 152 small- and medium-sized enterprises that had begun bankruptcy proceedings were studied. Expert systems were used for their analysis, based on classification trees assembled through boosting and bagging. In addition, the logistic regression was used as baseline to compare previous methods. The main result obtained was that a change in the norm that catalogs the going-concern issue as less serious made auditors more likely to report this situation, thus questioning the audit quality. The comparative study of synchronic occurrences of a particular construction in interactional corpora from different languages can provide a complete understanding of the development of the construction as a response to some basic intimately associated set of interactional moves and cognitive demands. A comparative formal analysis of lists in Spanish and English conversations shows that in both languages the construction has developed a stylized intonation pattern based on the holding of tones by means of lengthening of nuclear syllables, a durable (...) syntactic organization based on parataxis and an almost identical inventory of lexicalized expressions to index the end of the list. A parallel analysis of lists in their interactional contexts shows that in both English and Spanish conversation the formal properties of lists emerge as adaptations to a recurrent set of communicative tasks. El trabajo explora críticamente la idea de una justificación débil o pen última de la moral enmarcándola en el conjunto de la filosofía de Tugendhat, reordenan do sus escritos éticos y discriminando los diversos aspectos que incluye dicha idea. Entre ellos, revisa el concepto formal de moral, ligado a los sentimientos, antes de centrarse en el punto crucial: la fundamentación de la ética moderna. Aquí se distingue, por un lado, la justificación comparativa de un contractualismo igualitario frente a otras alternativas (...) teóricas y, por otro, los motivos que pueden llevar (more heideggeriano, en realidad) a un individuo autónomo a entenderse en términos morales. La modernidad se caracteriza por una epistemología que ha conducido a la separación de los saberes. Como consecuencia, tanto la teología protestante como la católica han sufrido la falta de una perspectiva unitaria en su razonar sobre Dios. La cultura postmoderna, aceptando la fragmentariedad, presenta una nueva sensibilidad epistemológica que abre posibilidades prometedoras para el redescubrimiento de la trascendencia. Resumen: Con el fin de encontrar una configuración pertinente para la teología práctica en el actual contexto teológico, este articulo propone comprenderla y practicarla como teología de la acción. Se identifica primero la presencia de una dimensión práctica en las teologías premodernas, lo cual señala una nota fundamental del saber teológico y sirve de antecedente a nuestra subdisciplina. Hecho esto, se analizan los enfoques históricos más relevantes en la teología práctica como subdisciplina: uno centrado en los oficios del pastor con (...) un modelo aplicativo, otro enfocado en las prácticas eclesiales con un procedimiento deductivo y un tercero abierto a la actividad humana con una dinámica correlacional. Para profundizar este tercer enfoque, se presenta una propuesta metodológica en su comprensión de base y su actualización procedimental. En lo primero, se acoge la metáfora de la conversación continúa; en lo segundo, se desarrollan las dinámicas de la percepción, análisis y planificación. Comprender la teología práctica como teología de la acción implica asumir con radicalidad la convicción de que la correlación entre la acción de Dios y la acción humana, que dinamiza la experiencia de revelación-fe, debe fecundar también los caminos de la reflexión teológica. Abstract: With a view to configuring practical theology in the present theological context, this article suggests understanding it and practice it as a theology of action. The analysis, therefore, starts with identifying the presence of a practical dimension in pre-modern theologies, which points out a fundamental aspect of theological knowledge and serves as a forerunner of our modern sub-discipline. After that, the most relevant historical approaches in practical theology as a subdiscipline are described: the first one, centres on the pastor's duties using an applicative model, the second, focuses on ecclesial practices adopting a deductive procedure and the third one, looks at human activity through a correlational dynamic. To develop this third approach, the mutually critical correlation is developed in its basic understanding and its procedural implementation. For the first, the metaphor of the ongoing conversation is embraced; for the second, the dynamics of perception, analysis and planning are developed. Doing practical theology as theology of action implies radically holding firm the conviction that the correlation between God's action and human action, which energizes the experience of revelation-faith, must also inform and nurture the paths of theological reflection. La vida de cada cual es contingente, pero es una contingencia necesaria para una porción de vidas; aunque me atrevo a decir, incluso, que así es para la creación en continuidad. Creo que nosotros tenemos misión. La misión implica que aquello que no haga alguien quedará sin hacerse tal y como lo podría hacer esa persona. En otras palabras, la misión de cada cual, como la propia vida, exige y es disyunción,―o esto o aquello, así o de otro modo. Y (...) si tenemos en cuenta, que la realidad es sistemática, y que un sistema es orden de los elementos que se ve afectado por entero en caso de que suceda algo a alguno de los que lo componen, entonces para estar viviendo tal y como vivimos se nos revelan los otros como contingencias necesarias, imprescindibles. Bien podría hacer una aproximación a Pablo Posada desde la razón vital y algo habrá de ello a lo largo de estos párrafos, pero eso es una tarea prematura, como su muerte. (shrink)

El presente texto pretende analizar el concepto de 'destino' atribuido a Heráclito por ciertos autores de la antigüedad a la luz de los fragmentos del corpus heraclíteo y la doxografía disponibles. Se pretende mostrar la pertinencia de leer a los filósofos presocráticos, como Heráclito de Éfeso, en un contexto enriquecido por fragmentos y material textual de otras clases (doxografía, reminiscencias y paráfrasis) a fin de ofrecer una explicación para la atribución del término ειμαρμεν-eta o su correspondiente en latín 'fatum', al (...) filósofo Efesio. Este estudio analiza el artículo 146 del Código Orgánico Integral Penal (COIP) de Ecuador, esta trata sobre el homicidio culposo por práctica profesional equivocada. La mala praxis médica es un problema grave en el sistema de salud de Ecuador, y la interpretación inadecuada de este artículo ha generado confusión en los procesos legales relacionados. El objeto de la investigación es analizar la normativa del artículo 146 del COIP y las lagunas de interpretación jurídica para determinar la culpabilidad o inocencia de (...) los profesionales de la salud. Para ello, se emplearán métodos comparativos e históricos, que incluyen revisión bibliográfica, análisis de contenido del artículo 146. Los resultados esperados son demostrar las dudas razonables en la prueba del delito de mala praxis, resaltar la importancia de la bioética en los procedimientos legales. Este estudio busca contribuir a una mejor comprensión del marco legal y brindar ideas para la resolución de casos de mala praxis y homicidio culposo en Ecuador. (shrink)
